In cases where MSDE has been informed that a hearing decision is being appealed in accordance with Section 615(i) of IDEA 2004, an asterisk (*) is placed next to the OAH Case #. The civil or district court number of the case is provided when available.
Decision Summary: The ALJ concluded that because the student was not identified as having a disability under the IDEA, there was not a basis to identify him as a student requiring special education services.
Decision Summary: The ALJ found procedural violations but also determined that they did not impact FAPE because the student was not identified as a student with a disability under the IDEA. However, the ALJ ordered that the PGCPS convene an IEP team to evaluate the student and ordered the IEP team to determine compensatory services for the delay should they determine that the student is eligible to receive special education services.
